So if it went the other way it wouldn't be activism?? Funny how that works, isn't it?

The entire bill is a judicial nightmare that would FOREVER plague the court system beyond comppare.

Its only activism when they are applying original intent. Duhh!

We were asked to pass the bill if we wanted to know what is in it. Ok, we

passed it. Now that we know what's in it, we have the right to disagree with the constitutionality of any part of it.  It is not a display activism, but rather patriotism. The passage of a federal mandate like this sets a precedent for horrible things ahead of us. For this reason alone, we need to defeat the mandate portion.
When all else fails, do the opposite...

If they strike down mandatory medical insurance payments, it will clearly open the door for an attack on the legality of mandatory Medicare deductions, if they don't address it at the same time.

It's pretty funny how the rightwing complains about "Judicial activism" whenever a ruling goes against their beliefs..but when a rightwing Supreme Court, with members married to active political lobbyists, refuse to recuse themselves for a conflict of interest then there is no problemo!

Hypocrisy.

Nothing more original that left wing talking points Tobus.

Is he talking about Sotomayor or Kagan?  I believe it is Kagan that has the only real conflict of interest here.

This court doesn't make many sweeping decisions so it be a mix and match type decision.

When they do announce their decison they should have C. Thomas act as the spokesperson, just so we can hear him speak.

LOL....

Its funny... if C Thomas was as liberal as T Marshall (who notoriously sleep through meetings) comments such as yours would be considered racist by people like you.

Fair point, however, Clarence (Tom) Thomas is a very difficult person to like.
